Buyer vs Seller Paperwork: Who Does What?
In a private vehicle sale, both buyer and seller have paperwork responsibilities. Confusing the two is a common source of problems. This guide clarifies who does what.
Seller responsibilities
The seller is responsible for: Signing the title over to the buyer · Completing the odometer disclosure · Providing a bill of sale (even if not required) · Removing personal items and clearing any toll transponders · Notifying the state of the sale (release of liability where required) · Canceling insurance after delivery of the vehicle.
Buyer responsibilities
The buyer is responsible for: Submitting the signed title to the state motor vehicle agency · Paying applicable sales tax and title transfer fees · Registering the vehicle within the state deadline · Obtaining minimum required insurance before driving · Paying any outstanding registration fees or property taxes due.
Who pays the sales tax?
In most states, the buyer pays sales tax on the purchase price when registering the vehicle. Some states use the 'Standard Presumptive Value' (like Texas) if the declared sale price is below market value. Confirm with your state's motor vehicle agency.
